CFC Adds Affirmative AI Coverage to Media Liability Policy

CFC announced on July 29, 2026, that affirmative AI coverage is going into its Media policy, effective July 30. The update tells brokers that AI’s involvement in a media activity does not by itself stop the policy from responding to defamation, IP infringement and the rest of the media and professional liability grant. The policy’s cyber coverages get the same treatment, lifted to the level of protection CFC writes in its Cyber Proactive Response product, with AI hallucinations and LLM prompts that take systems down as the worked example. This is the second step in a program CFC announced on June 25, when it said the language would run across seven policies, media among them.

The market signal is the direction of travel. Since 2025 the default posture has been exclusion rather than affirmation, and the ISO endorsements and the W. R. Berkley wording both work by narrowing what a policy will answer for. CFC is going the other way on a live form, and it is doing it on a media book, where AI-assisted output stopped being hypothetical some time ago.

The underwriting implication is that policy review now has a new question. Carriers and brokers reviewing media, E&O and cyber forms need to ask whether AI-generated output is covered, excluded, or silent. A form that says nothing about AI leaves the question to be settled later in a claims dispute, on facts nobody has yet. CFC’s move suggests the market is starting to price the difference between explicit cover and ambiguous silence.

CFC has not published the definition, and on this kind of form the definition is the whole question. An affirmative grant reaches exactly as far as the term it affirms, so a policy that says AI is covered has said nothing measurable until that term is on paper. Until the wording circulates, affirmative AI coverage is a market position more than a coverage position. Which books it would matter most in is a question of where AI is already running, and the business-line map tracks that.
